One thing that upset me about re-reading the Wal-Mart case was the "erasing hours from time cards." That's outright theft on the part of Wal-Mart's managers and should definitely be addressed.

I still find the class action route overkill with warped incentives, rewards, and costs.

There is no doubt that life is hard, wealth is unequally distributed, and many live on the margin, constantly struggling to make minimum required payments. This is not a good thing, but forced redistribution schemes to take property from those that produce is dangerous and counterproductive in the long term.

“At any point at which a worker feels exploited he can walk away from the job” and presumably take food from a child’s mouth, default on mortgage payments and forcibly evict themselves! After all it’s not like people require to work to live or anything!
Capitalism is essentially a flawed system that thrives on the exploitation of the masses, let’s face it you’re not the one working 15 hours a day for 10 pence in a sweat shop chucking out consumer goods, but if you were you might find some comfort in a lawyer willing to champion your cause, albeit out of their own self interest.
